I thought that Slaw readers might be interested in this observation by BLG partner, Norman Letalik, as a result of his recent exchange with Apple Canada?s regional counsel. (The following quotation is from an email thread in a group to which I belong and is reproduced with Norm Letalik?s permission.)

Note that I have now had a telephone conversation with Ms. Famulak, who is regional counsel for Apple Canada. She confirms that the information that is dictated on the Apple iPhone 4s using the Siri dictation feature is sent to servers that reside in the US and that Apple, its related companies and agents have access to the contents of what is dictated. She did not wish to opine on whether Apple?s ability to access dictated client communications would breach legal privilege in Ontario or elsewhere. So, the best practice would be not to use the dictation feature on an iPhone 4s for any dictated information to which you intend legal privilege to attach. Note as well that Apple?s dictation servers are located in the US, so the dictated information may also be scanned for national security purposes by the US Government pursuant to powers given to it under the Patriot Act.

In his request to Ms Famulak, Mr. Letalik noted that lawyers ?likely did not read your 364 pp user agreement document carefully enough to understand the implications of the above terms and conditions.?

The problem with privilege in this context is explained by Professor Adam Dodek, a new contributor on Slaw, in his February 2011 discussion paper for the Canadian Bar Association, ?Solicitor-Client Privilege in Canada: Challenges for the 21st Century?:

As the House of Lords has stated, the sine qua non of privilege is confidentiality: ?Unless the communication or document for which privilege is sought is a confidential one, there can be no question of legal advice privilege arising. The confidential character of the communication or document is not by itself enough to enable privilege to be claimed but is an essential requirement.? The CBA has issued ?Guidelines for Practicing Ethically with New Information Technologies,? which declares that ?Lawyers should exercise the same care to protect the confidentiality and privilege of electronic communications as is normally expected of them using any traditional form of communication.?

Certain knowledge that a communication is open to others to read may ipso facto prevent the attachment of privilege.

Report: Herbicide atrazine spurs reproductive problems in many creatures

CHAMPAIGN, Ill. An international team of researchers has reviewed the evidence linking exposure to atrazine an herbicide widely used in the U.S. and more than 60 other nations to reproductive problems in animals. The team found consistent patterns of reproductive dysfunction in amphibians, fish, reptiles and mammals exposed to the chemical.

Atrazine is the second-most widely used herbicide in the U.S. More than 75 million pounds of it are applied to corn and other crops, and it is the most commonly detected pesticide contaminant of groundwater, surface water and rain in the U.S.

The new review, compiled by 22 scientists studying atrazine in North and South America, Europe and Japan, appears in the Journal of Steroid Biochemistry and Molecular Biology.

The researchers looked at studies linking atrazine exposure to abnormal androgen (male hormone) levels in fish, amphibians, reptiles and mammals and studies that found a common association between exposure to the herbicide and the "feminization" of male gonads in many animals.

The most robust findings are in amphibians, said Val Beasley, a University of Illinois emeritus professor of comparative biosciences and co-author of the review. At least 10 studies found that exposure to atrazine feminizes male frogs, sometimes to the point of sex reversal, he said.

Beasley's lab was one of the first to find that male frogs exposed to atrazine in the wild were more likely to have both male and female gonadal tissue than frogs living in an atrazine-free environment. And in a 2010 study, Tyrone Hayes, a professor of integrative biology at the University of California at Berkeley and lead author of the review, reported in the Proceedings of the National Academy of Sciences that atrazine exposure in frogs was associated with "genetic males becoming females and functioning as females," Beasley said.

"And this is not at extremely high concentrations," he said. "These are at concentrations that are found in the environment."

The new review describes the disruptions of hormone function and sexual development reported in studies of mammals, frogs, fish, reptiles and human cells exposed to the herbicide. The studies found that atrazine exposure can change the expression of genes involved in hormone signaling, interfere with metamorphosis, inhibit key enzymes that control estrogen and androgen production, skew the sex ratio of wild and laboratory animals (toward female) and otherwise disrupt the normal reproductive development and functioning of males and females.

"One of the things that became clear in writing this paper is that atrazine works through a number of different mechanisms," Hayes said. "It's been shown that it increases production of (the stress hormone) cortisol. It's been shown that it inhibits key enzymes in steroid hormone production while increasing others. It's been shown that it somehow prevents androgen from binding to its receptor."

The review also consolidates the evidence that atrazine undermines immune function in a variety of animals, in part by increasing cortisol.

"Cortisol is a nonspecific response to chronic stress," Beasley said. "But guess what? Wildlife in many of today's habitats are stressed a great deal of the time. They're stressed because they're crowded into little remnant habitats. They're stressed because there's not enough oxygen in the water because there are not enough plants in the water (another consequence of herbicide use). They're stressed because of other contaminants in the water. And the long-term release of cortisol causes them to be immuno-suppressed."

There also are studies that show no effects or different effects in animals exposed to atrazine, Beasley said. "But the studies are not all the same. There are different species, different times of exposure, different stages of development and different strains within a species." All in all, he said, the evidence that atrazine harms animals, particularly amphibians and other creatures that encounter it in the water, is compelling.

"I hope this will stimulate policymakers to look at the totality of the data and ask very broad questions," Hayes said. "Do we want this stuff in our environment? Do we want knowing what we know our children to drink this stuff? I would think the answer would be no."

Newt Gingrich: Union Leader endorsement a big boost in New Hampshire

In a front page editorial Sunday, New Hampshire's prominent statewide Union Leader newspaper endorsed Newt Gingrich. It's a big boost for Gingrich and a blow to Mitt Romney, currently leading in polls.

Newt Gingrich?s presidential campaign just got a big boost in New Hampshire ? the state holding the first Republican primary election.

The Union Leader, the state?s most prominent publication and a leading voice in conservatism, says it?s backing Gingrich over Mitt Romney.

Romney, who holds a commanding lead in New Hampshire polling, is still the man to beat there. But the Union Leader?s rejection of his candidacy is a blow nonetheless ? particularly since Gingrich has vaulted past his GOP rivals to claim neck-and-neck status with Romney in national Republican polls as well as likely-voter surveys in other states.

The newspaper?s endorsement ? spread across the top of the front page in the Sunday edition and signed by publisher Joseph W. McQuaid ? carries a granite-like tone typical of a publication prominent in Republican politics. Four years ago, its endorsement of John McCain helped propel McCain passed Romney to a win in New Hampshire and to his party?s nomination.

"We are in critical need of the innovative, forward-looking strategy and positive leadership that Gingrich has shown he is capable of providing," the newspaper wrote in its editorial.

"We don't back candidates based on popularity polls or big-shot backers,? the paper declared in obvious reference to Romney. ?We look for conservatives of courage and conviction who are independent-minded, grounded in their core beliefs about this nation and its people, and best equipped for the job.?

"We don't have to agree with them on every issue," the newspaper wrote about Gingrich, some of whose positions (on immigration, for example) have rankled conservatives. "We would rather back someone with whom we may sometimes disagree than one who tells us what he thinks we want to hear."

Writes Maggie Haberman at Politico.com: ?It's the most significant?and impactful endorsement in the GOP race so far, and solidifies Gingrich's standing as the alternative to Romney as the race heads into the final pre-Iowa caucuses stretch.?

While the Union Leader?s endorsement shakes things up, Romney remains the clear front-runner in New Hampshire, a state where he owns a home and where he?s well-known because of his time as governor of neighboring Massachusetts.

Strong global sales boost Tiffany's 3Q results (AP)

NEW YORK ? Jewelry seller Tiffany & Co. said Tuesday its fiscal third quarter profit rose 63 percent on strong sales globally, particularly in Asia.

The luxury retailer known for its iconic turquoise box is also raising its full-year forecast as a result of the third-quarter performance.

But its fourth-quarter forecast fell below expectations and shares fell 6 percent in premarket trading. The fourth quarter includes the key holiday selling season.

Tiffany's results to date show the luxury shopper is spending freely. That segment has rebounded more quickly from the recession than others. High-end jewelry sold better than other categories. Tiffany operates 243 stores globally.

The New York company's net income rose to $89.7 million or 70 cents per share in the three months ended Oct. 31. That compares with $55.1 million, or 43 cents per share, a year ago. Analysts expected earnings of 60 cents per share, according to FactSet.

Revenue rose 21 percent to $821.8 million. Analysts expected $801.8 million.

"Increased sales in all regions contributed to the continuation of strong worldwide sales growth in the third quarter," said CEO Michael J. Kowalski.

In the Americas, sales grew 17 percent to $387.7 million. Revenue in stores open at least one year rose 16 percent.

The measure is considered a key gauge of a retailer's financial health because it excludes stores that open or close during the year.

Tourists helped push the measure up 30 percent Tiffany's the New York flagship store.

In Asia-Pacific, revenue rose 44 percent to $183.2 million, helped by strength in the greater China region.

Revenue rose 12 percent in Japan and 19 percent in Europe.

But the company said that in the fourth quarter, the company expects net income of $1.48 to $1.58 per share. Analysts expect $1.63 per share.

Its shares fell $4.82, or 6.6 percent, to $68.80 in premarket trading.

For the year, Tiffany expects earnings of $3.70 to $3.89 per share, for prior guidance of $3.65 to $3.75 per share. Analysts expect $3.72 per share.

Tiffany expects revenue to rise in the high-teens percentage for the year.

WASHINGTON (AP) ? Republican presidential hopeful Newt Gingrich landed the endorsement of New Hampshire's largest newspaper on Sunday while rival Mitt Romney earned a dismissive wave, potentially resetting the race in the state with the first-in-the-nation primary.

For Gingrich, the former House speaker, the backing builds on his recent rise in the polls and quick work to build a campaign after a disastrous start in the summer. Romney, the former Massachusetts governor who has a vacation home in the state and has been called a "nearly native son of New Hampshire," absorbed the blow heading into the Jan. 10 vote that's vital to his campaign strategy.

"We don't back candidates based on popularity polls or big-shot backers. We look for conservatives of courage and conviction who are independent-minded, grounded in their core beliefs about this nation and its people, and best equipped for the job," The New Hampshire Union Leader said in its front-page editorial, which was as much a promotion of Gingrich as a discreet rebuke of Romney.

The Union Leader's editorial telegraphed conservatives' concerns about Romney's shifts on crucial issues of abortion and gay rights were unlikely to fade. Those worries have led Romney to keep Iowa's Jan. 3 caucuses ? where conservatives hold great sway ? at arm's length.

At the same time, the endorsement boosts Gingrich's conservative credentials. He spent the week defending his immigration policies against accusations that they are a form of amnesty. On Monday, Gingrich takes a campaign swing through South Carolina, the South's first primary state.

Romney, taking a few days' break for the Thanksgiving holiday, has kept focused on a long-term strategy that doesn't lurch from one development to another. Last week, he picked up the backing of Sen. John Thune, a South Dakota conservative, to add to his impressive roster of supporters.

The Union Leader's rejection of Romney wasn't surprising despite his efforts to woo state leaders. The newspaper rejected Romney four years ago in favor of Arizona Sen. John McCain, using front-page columns and editorials to promote McCain and criticize Romney.

"It helped McCain a lot because it buttressed the time he spent there. McCain camped out in New Hampshire and was able to make good with The Union Leader," said Craig Stevens, a spokesman for Romney's 2008 bid who is not working for a presidential candidate this time.

"Now, the speaker has to spend the time there, too," Stevens said.

Since his first run, Romney courted publisher Joseph W. McQuaid. Earlier this year Romney and his wife, Ann, had dinner with the McQuaids at the Bedford Village Inn near Manchester, hoping to reset the relationship. It didn't prove enough.

Romney's advisers were quick to point out that Gingrich went into October with more than $1 million in campaign debt. Romney, meanwhile, was sitting on a pile of cash and only last week began running television ads ? a luxury Gingrich can't yet afford.

The duo's rivals, meanwhile, tried to gain traction.

Herman Cain on Sunday criticized any immigration proposal that included residency or citizenship but struggled to explain how he would deal with the millions of people estimated to be currently living illegally in the United States.

Cain, who had enjoyed a polling surge, has seen his luster fade as his seemed to have trouble articulating the nuances of his policy positions. For instance, he was unable to explain the difference between "targeted identification," which he says would determine common characteristics of people who want to harm the United States, and racial profiling.

At the same time, Cain acknowledged that accusations that he sexually harassed several women during his days running the National Restaurant Association in the 1990s have pulled him from among the front-runners. He has flatly denied the allegations repeatedly.

While Romney enjoys solid support in national polls, many Republicans have shifted from candidate to candidate in search of an alternative. That led to the rise ? and fall ? of potential challengers such as Cain, Rep. Michele Bachmann of Minnesota and Texas Gov. Rick Perry.

Romney enjoys solid leads in New Hampshire polls, too. A poll released last week showed him with 42 percent support among likely Republican primary voters in the state. Gingrich followed with 15 percent in the WMUR-University of New Hampshire Granite State poll.

Rep. Ron Paul of Texas posted 12 percent support and former Utah Gov. Jon Huntsman found 8 percent support in that survey.

Those numbers could shift based on the backing of The Union Leader, a newspaper that proudly works to influence elections, from school boards to the White House, in the politically savvy state.

"With Newt, the endorsement alone won't get him closer to Romney. But if The Union Leader kicks the you-know-what out of Romney, that could help Gingrich," said Mike Dennehy, a Republican consultant and former McCain aide who is neutral in the presidential contest.

Huntsman, President Barack Obama's former ambassador to China, said the endorsement points to how competitive the New Hampshire contest is.

"A month ago for Newt Gingrich to have been in the running to capture The Union Leader endorsement would have been unthinkable," Huntsman said in an interview Sunday during a break in campaigning.

The endorsement, signed by McQuaid, suggested that New Hampshire's only statewide newspaper was ready to assert itself again as a player in the GOP primary ? even if the newspaper has reservations.

"We don't have to agree with them on every issue," McQuaid wrote. "We would rather back someone with whom we may sometimes disagree than one who tells us what he thinks we want to hear."

With six weeks until the primary, The Union Leader's move could again shuffle the race, further boosting Gingrich and driving a steady stream of criticism against his rivals. In recent weeks, Gingrich has seen a surge in some polls as Republicans focus more closely on deciding which candidate they consider best positioned to take on Obama.

He has also started to put together a campaign organization in New Hampshire. He brought on respected tea party leader Andrew Hemingway and his team has been contacting almost 1,000 voters each day. Gingrich hasn't begun television advertising and has refused to go negative on his opponents.

The newspaper has a decidedly mixed record of picking candidates. It backed Steve Forbes in 2000 and Pat Buchanan's 1992 and 1996 bids. Neither candidate won the Republican nomination.

Gingrich, who left the House in 1999 after disastrous midterm elections for the GOP, has faced skepticism about his personal life. He is married to his third wife and acknowledged infidelity during his first two marriages.

Even so, voters are giving Gingrich a look ? and the timing appears to be ideal for him.

"Romney is a very play-it-safe candidate. He doesn't want to offend everybody or anybody," said Drew Cline, the op-ed editor of The Union Leader. "He wants to be liked. He wants to try to reach out and be very safe, reach out to everybody, bring everybody on board."

That isn't the brand of candidate The Union Leader was looking to back, he said.
